I got yet another robocall yesterday and another this morning from someone who is trying to get me to switch my electrical service to them as a supplier.

Since my number is on the national do not call registry, this leads to one simple question:

Why would I want to do business with criminals?

Once upon a time, I was very active in trying to combat email spam. Although some of the spammers who showed up on the related Usenet group were crooks by nature and intent, there were a fair number who just couldn't accept that the rules applied to them. The frequent attitude was, "Well, technically I may be doing everything wrong but my message is...important!"

I got a call a couple of weeks ago purporting to be a charity fund raising call -- if I let this window company come out and give me a quote on replacing my windows, the company would donate $100 to some charity. I wonder how much the charity actually got?

DNC violations are, I believe, civil violations rather than crimes. However, if you're saying that telemarketers who commit such violations are very likely out to defraud you, you're right.

Under UK law, Fraud is a criminal act ... but it's whether something like the Do Not Call list is backed up by some sort of mala prohibita that would make violation a criminal act, that's an interesting question, and it may vary from state to state.

But IANAL ;-)

The DNC list is enacted by federal regulation or legislation (it's often hard to keep track of which is in effect), and state law usually stands clear where federal regulations apply.

Hmmm - just got one of those myself, so I pressed 0 to talk to a representative since I was given that option, but she hung up immediately when I asked why they were calling a number on the DNC list.

I've heard some companies claim that they've outsourced the cold calling so it's not -them- breaking the rules. I wonder how the law is written? It's against the law either way, but maybe they can avoid being fined?
